2. Our Products

Blame Sylvia! offers gifts, personalized items, accessories, home and lifestyle products, seasonal collections and other selected merchandise.

Some products are shipped directly by our fulfillment and dropshipping partners, while others are dispatched from our own stock.

We aim to provide accurate product descriptions, photographs, dimensions, materials and specifications.

However, colors may appear slightly different depending on your screen settings.

We will not substitute materially different products without your agreement.

3. Orders and Contract Formation

By placing an order, you confirm that the information you provide is accurate and complete.

Before submitting your order, you will be able to review the products, quantities, prices, delivery charges and applicable taxes.

After placing an order, you will receive an order acknowledgement.

A sales contract is formed when we accept your order, normally by sending an order confirmation.

If we cannot accept or fulfill an order, we will inform you and refund any payment collected for products we cannot supply.

We reserve the right to reject orders for legitimate reasons, including suspected fraud, unlawful transactions or unavailable products, subject to applicable law.

4. Prices and Payments

Product prices are displayed in the currency shown at checkout.

Applicable taxes and any mandatory charges will be disclosed before the order is placed.

Shipping costs are displayed during checkout.

Any import duties, customs charges or other additional fees payable by the customer will be clearly disclosed before purchase where required by law.

Payments are processed through the payment methods offered at checkout.

We do not guarantee the availability of any particular payment method at all times.

5. Shipping and Delivery

We may ship orders ourselves or through third-party fulfillment partners.

Products within the same order may arrive in separate packages.

Estimated delivery times are displayed on the relevant product pages, during checkout or in our Shipping Policy.

Delivery estimates are not guaranteed delivery dates unless expressly agreed.

We will deliver within the agreed period or, where no delivery period has been agreed, within the time required by applicable law.

For EU consumer purchases, this generally means delivery within 30 days unless a different period has been agreed.

If delivery is delayed, you may have the right to request delivery within an additional appropriate period and, where legally permitted, cancel the order if delivery does not occur.

The risk of loss or damage generally remains with us until you or a third party designated by you, other than the carrier, takes physical possession of the goods, subject to applicable law.

6. Returns and Right of Withdrawal

Consumers in the European Union and European Economic Area generally have a statutory right to withdraw from eligible online purchases within 14 days after receiving the goods, subject to legal exceptions.

Details of the withdrawal procedure, return address, return shipping costs, refund timing and applicable exceptions are explained in our separate Return & Refund Policy.

You can view that policy here:

https://www.blamesylvia.com/policies/refund-policy

Nothing in these Terms restricts your statutory withdrawal rights.

7. Personalized and Custom-Made Products

Certain products may be customized with names, messages, photographs or other customer-provided specifications.

Please review all customization details carefully before submitting your order.

Products made to your specifications or clearly personalized may be exempt from the statutory right of withdrawal where applicable law permits.

This exception does not affect your rights if the product is faulty, incorrectly personalized due to our error or otherwise does not conform to the contract.

You confirm that you have the necessary rights to any text, photographs or designs you submit for customization.

You must not submit content that infringes third-party rights or is unlawful.

8. Faulty, Damaged or Incorrect Products

We are responsible for providing goods that conform to the sales contract.

If a product is faulty, damaged, incorrect or not as described, please contact:

info@blamesylvia.com

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction or a refund.

EU consumers generally benefit from a minimum two-year statutory legal guarantee for goods, subject to applicable national law.

Any commercial warranty offered with a product is additional to, and does not replace, your statutory rights.

9. Promotions and Discount Codes

We may offer discounts, promotional codes and limited-time offers.

Any specific conditions, eligibility requirements and expiration dates will be communicated with the relevant promotion.

Promotions cannot be applied retrospectively unless expressly stated.

We reserve the right to correct genuine promotional errors and prevent fraudulent use, subject to applicable law.

10. Customer Accounts

You may be able to create a customer account to manage your orders and personal information.

You are responsible for maintaining the confidentiality of your account credentials.

Please notify us if you suspect unauthorized access.

We may restrict access to an account where reasonably necessary to protect security, prevent fraud or comply with legal obligations.

11. Website Use

You agree not to misuse our website or interfere with its security, availability or functionality.

You must not use our website for unlawful activities, fraudulent transactions, malicious software distribution or infringement of third-party rights.

We may take proportionate measures to protect the website, customers and our business.

12. Intellectual Property

The Blame Sylvia! brand name, original website content, graphics, product descriptions and other original materials are protected by applicable intellectual property laws where relevant rights exist.

You may not reproduce or commercially exploit our protected content without authorization, except where permitted by law.

Third-party trademarks, images and product materials remain the property of their respective rights holders.

13. Reviews and Customer Content

Customers may be able to submit product reviews, comments or other content.

You agree that submitted content must be lawful, accurate to the best of your knowledge and must not infringe the rights of others.

We may moderate or remove unlawful, fraudulent or abusive content in accordance with applicable law.

We will not knowingly present fabricated reviews as genuine customer experiences.

14. Privacy and Personal Data

We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR where applicable.

Our Privacy Policy is available at:

https://www.blamesylvia.com/policies/privacy-policy

Please read it to understand how your personal information is collected, used and protected.

15. Third-Party Services

Our store is powered by Shopify and may use third-party payment providers, shipping carriers, fulfillment partners and other service providers.

These providers may process information or perform services necessary to fulfill your order.

Our use of third-party providers does not remove our responsibilities as the seller under applicable consumer law.

Links to external websites are provided for convenience. We are not responsible for the independent content or practices of third-party websites, except where applicable law provides otherwise.

16. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or restricted, including mandatory consumer rights and liability for fraud, intentional misconduct or other matters protected by applicable law.

To the extent permitted by law, we are not responsible for losses caused solely by circumstances outside our reasonable control.

This clause does not affect any statutory remedies available to consumers for non-delivery, faulty goods or other breaches of contract.

17. Events Beyond Our Reasonable Control

Events such as natural disasters, serious transport disruptions or other extraordinary circumstances may affect our ability to fulfill orders.

If such an event occurs, we will inform affected customers where reasonably possible and explain the available options.

Your mandatory rights concerning delivery, cancellation and refunds remain unaffected.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, services or legal obligations.

The updated version will be published on our website with a revised date.

Changes will not retrospectively remove rights already acquired under an existing sales contract.

19. Governing Law and Consumer Disputes

These Terms are governed by Belgian law, except where mandatory consumer protection rules of another applicable jurisdiction provide greater or otherwise non-excludable protection.

Nothing in these Terms deprives consumers of mandatory protections under the laws applicable to their place of habitual residence.

Any dispute concerning a consumer purchase will be handled in accordance with applicable jurisdiction and consumer protection rules.

We encourage customers to contact us first so we can try to resolve concerns amicably.

Customers may also have access to consumer advice services, alternative dispute resolution bodies or competent courts as provided by law.
